
TEMPO.CO, Jakarta - The United States International Trade Court has blocked the comprehensive import tariffs imposed by President Donald Trump. As reported by Kyodo and quoted by Antara, the court found that Trump had exceeded his authority in imposing massive import duties on trading partner countries. The New York-based court ruled that the emergency law set by the White House could not unilaterally grant the president the authority to impose tariffs on nearly every country in the world.
The court stated that the U.S. Congress has the exclusive authority to regulate trade with foreign countries based on the U.S. Constitution. Furthermore, according to the court's decision, this authority cannot be overridden by the president's declaration of a national emergency to justify the policy of comprehensive tariffs.
As CNBC reported, the court issued a permanent ruling on all comprehensive tariff policies issued by Trump since taking office in January. The court ordered the Trump administration to issue new policies reflecting this decision within 10 days.
The court blocked the tariffs imposed last month on nearly all of America's trading partners, as well as previous tariffs on Canada, China, and Mexico.
The Manhattan-based court not only ordered the permanent cessation of most of Trump's tariffs but also prohibited any future modifications.
The three-judge panel gave the White House 10 days to complete the formal process of halting import tariffs. The Trump administration immediately filed an appeal against the decision.
The decision was based on two separate cases. The nonpartisan Liberty Justice Center filed one case on several small businesses that import goods from countries targeted by import duties. Meanwhile, a coalition of U.S. state governments has taken legal action in the form of another case to oppose import tariffs.
Both cases mark the first major legal challenge to what Trump called the "Liberation Day" tariffs.
Last April, Trump imposed reciprocal tariffs on countries with trade deficits with the U.S., as well as a basic 10 percent tariff on nearly all countries. However, He later suspended specific reciprocal tariffs on certain countries for 90 days.
In February, Trump also imposed tariffs on Canada, Mexico, and China, citing the need to stop the flow of illegal immigrants and drug trafficking across the U.S. border.
The White House criticized the decision, although Trump has not directly commented. "It is not for unelected judges to decide how to properly address a national emergency," said White House deputy press secretary Kush Desai in a statement.
"President Trump pledged to put America First, and the Administration is committed to using every lever of executive power to address this crisis and restore American greatness," Desai added.
However, New York Attorney General Letitia James, one of the 12 states involved in the lawsuit, welcomed the decision.
"The law is clear: no president has the power to single-handedly raise taxes whenever they like," said Letitia James.
"These tariffs are a massive tax hike on working families and American businesses that would have led to more inflation, economic damage to businesses of all sizes, and job losses across the country if allowed to continue," James emphasized.
Following the court's decision, global markets, including Tokyo stocks, strengthened as the decision eased concerns about the impact of U.S. tariffs on the world economy.
