TEMPO.CO, Jakarta - The Constitutional Court (MK) will hold a plenary session today, Tuesday, February 4, 2024. The plenary session is scheduled to read out the interim or dismissal decision from the MK for the lawsuit for the dispute over the results of the regional head general election (PHPU) or the Pilkada election dispute that has been submitted previously.
Spokesperson for the MK judges, Enny Nurbaningsih, confirmed that the verdict reading session will be held in a plenary session and not divided into several panels of judges. The session will be led by Chief Justice of the Constitutional Court Suhartoyo in the Courtroom of Building I of the MK.
The agenda for today's plenary session will include disputes over the results of the North Sumatra and East Java gubernatorial elections. "The event of pronouncing the verdict/ruling," as written on the official MK website accessed on Tuesday morning, February 4, 2025.
The reading of the dismissal decision of the dispute lawsuit with the applicant, the candidate pair for governor and deputy governor of North Sumatra Edy Rahmayadi-Hasan Basri Sagala, is planned to be held at 08:00 WIB (Western Indonesian Time).
Citing the MK website, the lawsuit by the Edy-Hasan camp is registered with case number 247/PHPU.GUB-XXIII/2025. The Edy-Hasan camp is suing the recapitulation results of the General Election Commission (KPU) which declared victory for Bobby Nasution-Surya.
They accused there of interference and involvement of state civil servants and "brown parties" to win the victory of the 7th President Joko Widodo's son-in-law, Bobby Nasution.
Meanwhile, the hearing for pronouncing the interim decision on the dispute lawsuit with the applicants for the East Java gubernatorial and deputy gubernatorial candidates Tri Rismaharini and Zahrul Azhar Asumta (Gus Hans) will begin in the evening, at 19.30 WIB. The Risma-Gus Hans camp's case is registered with the number 265/PHPU.GUB-XXIII/2025.
The Risma-Gus Hans camp requested the disqualification of their rivals, Khofifah Indar Parawansa and Emil Elistianto Dardak from the East Java gubernatorial election. In their petitum, they argued that Khofifah-Emil had committed violations in a structured, systematic, and massive manner.
Previously, the Constitutional Court had finished holding a hearing with the agenda of preliminary examination and trial examination for 310 cases from January 8-31, 2025. Of the total 310 cases, 23 of them were PHPU cases for the governor and deputy governor. Meanwhile, for PHPU of mayor and deputy mayor, there are 49 cases, and 238 other cases are PHPU cases of Regent and Deputy Regent.
In the previous trial process, the Constitutional Court divided the trial into three panels of judges. Each panel of judges has heard the main points of the petition from the applicant which was continued by hearing the response of the KPU as the respondent. The Constitutional Court has also heard statements from the General Elections Supervisory Body (Bawaslu) and related parties.
Through this dismissal verdict hearing, it will be known which cases will be continued to the further trial examination stage on February 7-17. In this trial stage, each party will be given the opportunity to present witnesses or experts.
For PHPU cases of the Governor, the parties are given the right to present witnesses or experts as a whole, a maximum of six people. Meanwhile, in PHPU cases of Regent and Mayor, overall the parties are allowed to present a maximum of four witnesses or experts.
The reading of the dismissal verdict is known to have been accelerated from the initial schedule previously set by the Constitutional Court. Based on Constitutional Court Regulation (PMK) Number 14 of 2024, the dismissal reading should have been read by the panel of judges on February 11-13, 2025. However, the Constitutional Court moved the hearing forward to February 4-5, 2025.
