Judge rules in favor of former NFL WAG after she outed size of ex-husband's manhood: 'Matter of legitimate public concern'

Haley Kalil has been granted her request to throw out her ex-husband Matt Kalil's lawsuit against her. 

She was sued by the former NFL star after publicly claiming his huge penis ended their marriage.

The Sports Illustrated Swimsuit model publicly discussed their marriage and sex life during an appearance on a livestream on Twitch in November 2025. She described his penis as 'two coke cans, maybe even a third'. 

Former Vikings and Panthers offensive lineman Matt Kalil was seeking a jury trial and damages of more than $75,000 in the wake of the comments.

The couple married in 2015 and were together for seven years before their split in 2022. Matt has since remarried model Keilani Asmus and claimed in his lawsuit she has received a barrage of disgusting messages about his genitals since her comments that he claimed have become 'increasingly frequent, disturbing and alarming in nature over time.'

But U.S. District Judge Patrick Schiltz sided with Haley Kalil and dismissed his suit, ruling that her remarks were tied to subjects of public interest including her life, marriage and divorce.

Haley told TMZ, who reported the ruling: 'I am so relieved this is over. I never wanted to be in a courtroom discussing matters of my own life. 

'I think this ruling is important and I hope it encourages women everywhere to speak openly about what they've been through. Your story belongs to you and you shouldn't fear sharing it.'

Per the Minnesota Star Tribune, Judge Schiltz: 'If the only source of Matt's celebrity was his career as a football player - and if Haley was just a random social‐media maven who passed on gossip about the size of Matt's penis to get a laugh or to attract attention - then the Court would readily find that Haley's comments were not of legitimate public concern.

'For these reasons, the Court finds that Haley's remarks about the size of Matt's penis and its impact on her health and marriage were remarks about a matter of legitimate public concern.'

He concluded: 'In short, Haley was discussing her life, not Matt's, and the law generally protects a person's speech about herself, even though such speech inevitably reveals details about others.'

Haley's attorney, Matt Bialick, said in a statement: 'No woman should need her ex-husband's permission to tell the story of her own marriage.

'No woman should be sued for talking about her own body. We hope this ruling gives women everywhere the confidence to share their own stories.' 

The ex-football player claimed in his lawsuit that he has been subjected to 'unwanted attention and invasive commentary from the public,' while his family has 'been forced to endure the ongoing public circulation of these degrading and deeply personal statements.'

Back in February, Haley Kalil argued her comments were protected by the First Amendment in a filing calling for the lawsuit to be thrown out.  

'A woman's right to provide a truthful account of her own relationships and her own past sexual trauma lies at the very core of First Amendment protections,' Haley's lawyer, Bialick, said. 'Mr. Kalil's brief mentioned the First Amendment a grand total of three times and offered no constitutional analysis whatsoever.

'We are more confident than ever that this case will be dismissed and that Ms. Kalil will be awarded her attorneys' fees.'

Bialick emphasized that his client did not specifically identify Matt when she discussed their sex life, writing: 'But Defendant also never used Plaintiff's name.

'The Complaint alleges only that 'viewers could and did readily infer' who she was discussing. The only reason viewers could 'readily infer' anything is because Defendant was a Sports Illustrated model and former Miss Minnesota USA married to an NFL player — a marriage publicly known precisely because both parties were public figures.'
