Komnas HAM Demands Strict Penalties for Ex-Ngada Police Chief

TEMPO.CO, Jakarta - Indonesia's National Commission on Human Rights (Komnas HAM) has called for strict legal and ethical sanctions against the inactive Ngada Police Chief, Adjunct Senior Commissioner Fajar Widyadharma Lukman Sumaatmaja, following allegations of child sexual abuse.

Komnas HAM emphasizes that, given Fajar's position as a law enforcement officer, any proven misconduct warrants severe punishment, aligning with the provisions of Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS).

The commission asserts that Fajar's alleged actions violate multiple statutes within Law Number 39 of 1999 concerning Human Rights. Specifically, Article 52, paragraph 1, mandates that every child is entitled to protection by parents, family, society, and the state.

Additionally, paragraph 2 recognizes children's rights as fundamental human rights, safeguarded by law from conception. Article 58, paragraph 1, further guarantees children legal protection against all forms of physical or mental violence, neglect, abuse, and sexual harassment, irrespective of the caregiver's identity.

Komnas HAM also references Article 15, letter f, of Law Number 35 of 2014, which amends Law Number 23 of 2002 on Child Protection, underscoring every child's right to protection from sexual crimes. Consequently, the commission deems Fajar's alleged conduct a severe human rights violation against children.

In addition to advocating for stringent penalties, Komnas HAM urges the state to facilitate victim recovery by providing psychological services, ensuring restitution or compensation during legal proceedings, and offering protection for witnesses and victims.

The commission also calls on the government to prevent future incidents, particularly within police ranks, by implementing regular evaluations, including routine drug testing and psychological assessments.

Following these allegations, Fajar was transferred to the Police Service Unit (Yanma Polri) at the National Police Headquarters. This reassignment occurred after suspicions arose regarding his involvement in drug use, child molestation, and the distribution of pornographic material to an Australian website. The transfer is documented in the National Police Chief's Telegram Letter Number: ST/489/III/KEP/2025, issued on March 12, 2025. The letter states:

"AKBP Fajar Widyadharma Lukman, Ngada Police Chief of NTT Regional Police, is reassigned as a Middle-ranking Officer at Yanma Polri."

Investigations by the Criminal Detective Directorate of the NTT Regional Police have identified a six-year-old victim in the molestation case involving the inactive Ngada Police Chief.

The victim was allegedly procured by an individual identified as "F," who facilitated the encounter at a hotel booked by Fajar. As of now, Fajar has not been formally declared a suspect in the child molestation case.
