TEMPO.CO, Jakarta - The Center of Economic and Law Studies (Celios) believes that the plan to classify ride-hailing (locally known as ojol) drivers as micro enterprises should not distract the government from the fundamental issue of their social protection.
Celios Digital Economy Director Nailul Huda stated that regardless of the status granted to ojol drivers, the government must ensure they receive adequate protection.
"Whether the drivers are categorized as MSMEs (micro, small, and medium enterprises) or workers, or whatever, what is clear is that they must receive health and social protections," Nailul told ANTARA in Jakarta on Thursday.
Nailul added that social protection is a non-negotiable aspect in the framework of the digital transportation sector, including through drivers' social security for health (BPJS Kesehatan).
Regarding the plan to classify ride-hailing drivers as MSMEs, Nailul questioned the additional benefits drivers would receive from the change in status.
According to him, if the goal is to allow drivers to access financing such as the People's Business Credit (KUR), these facilities should be accessible based on the type of business they operate.
"If they have a business, they deserve to receive the People's Business Credit (KUR). Why should they be directly included in the MSME category?" he said.
He also believes that government assistance should not be linked solely to their status as MSMEs, as those who are eligible must all receive government support in accordance with applicable regulations.
Deputy Speaker of the Indonesian House of Representatives, Sufmi Dasco Ahmad, stated in Jakarta on Tuesday that the parliament and government have finalized a Presidential Regulation on online transportation, which regulates the transportation of people, goods, and food.
Dasco explained that the Ministry of Communication and Digital will regulate tariffs for delivery of goods and food, while the fees for passenger transportation will be regulated by the Ministry of Transportation.
Meanwhile, online transportation drivers will be under the guidance of the Ministry of MSMEs.
Dasco said that after the regulation is finalized, the government will harmonize the provisions with ride-hailing drivers, ojol organizations, and app companies before the Presidential Regulation is issued.
