Hasto Kristiyanto Submits Three Expert Witnesses for KPK Probe

TEMPO.CO, Jakarta - Secretary General of PDIP, Hasto Kristiyanto, has submitted expert witnesses to the Corruption Eradication Commission (KPK). These experts are to be examined during the investigation phase.

Hasto’s lawyer, Ronny Talapessy, stated that a total of three mitigation expert witnesses have been proposed to the KPK. All three are academicians—two specialists in criminal law and one in constitutional law.

“The request for the appearance of mitigating experts has been submitted to the KPK this afternoon. There are three experts,” Ronny said in an official statement on Tuesday, March 4, 2025.

The three legal experts come from Universitas Negeri Surabaya, Universitas Veteran Jakarta, and Universitas Islam Indonesia.

According to Ronny, submitting mitigation expert witnesses during the investigation stage is a right of the suspect as regulated in Article 65 of the Criminal Procedure Code (KUHAP).

“After discussions within the defense team and in line with what Mr. Hasto stated, we decided to exercise the suspect’s right as provided in Article 65 of the KUHAP,” Ronny explained.

Ronny also reminded the KPK to adhere to the KUHAP and respect the rights of the suspect as enshrined in the law.

“The KPK must not bypass established procedures or violate applicable regulations by handling this case in a hasty manner,” he added.

Previously, the KPK had named the Democratic Party of the Struggle (PDIP) Secretary General Hasto Kristiyanto as a suspect in the case involving the escape of former PDI cadre Harun Masiku. Hasto is alleged to have bribed former KPU commissioner Wahyu Setiawan.

KPK Chair Setyo Budiyanto stated that in addition to Hasto Kristiyanto, the anti-corruption agency has also named Donny Tri Istiqomah as a suspect in the bribery case involving Harun Masiku.

Donny, a member of the PDI Perjuangan legal team, is accused of being Hasto’s trusted intermediary in delivering bribes to the former KPU commissioner, Wahyu Setiawan.

“HK directed and controlled DTI to actively collect and deliver the bribe money to Commissioner Wahyu Setiawan via Tio,” Setyo said at a press conference at the KPK’s Merah Putih Building on Tuesday, December 24, 2024.

Furthermore, Setyo disclosed that Hasto, Donny, and Saeful Bahri bribed Wahyu with the assistance of Agustina Tio Fridelina, transferring S$19,000 and S$38,350 between December 16 and 23, 2019.

“For these actions, the KPK issued Investigation Warrants No. Sprin.Dik/153/DlK.00/01/12/2024 on December 23, 2024, for suspect HK, and No. Sprin.Dik/154/DlK.00/01/12/2024 on the same day for suspect DTI,” Setyo said.

Setyo mentioned that Hasto and Donny are charged with violations under Article 5(1)(a) or Article 5(1)(b) or Article 13 of Law No. 20 of 2001 on the Eradication of Corruption, in conjunction with Article 55(1) paragraph 1 of the Criminal Code.

In addition to the bribery case, Hasto has also been named a suspect for obstruction of justice, as he allegedly assisted in the escape of Harun Masiku.

“On January 8, 2020, during the KPK’s sting operation, HK instructed Nurhasan to call Harun Masiku, advising him to submerge his phone in water and flee immediately,” Setyo said.

Regarding the obstruction of justice case, Setyo stated that Hasto is charged under Article 21 of Law No. 20 of 2001 on the Eradication of Corruption, in conjunction with Article 55(1) paragraph 1 of the Criminal Code.
