TEMPO.CO, Jakarta - Deputy Speaker of the Indonesian House of Representatives (DPR) Sufmi Dasco Ahmad confirmed that discussions on the draft Asset Forfeiture Bill will begin only after the revision of the Criminal Procedure Code Bill (KUHAP) is finalized.
Dasco explained that Commission III of the DPR is still gathering public input for the KUHAP draft. “So, we will discuss the Asset Forfeiture Bill once the KUHAP is completed,” he said at the Parliament Complex in Jakarta on Wednesday, September 24, 2025.
The KUHAP revision, which amends Law No. 8 of 1981 on the Criminal Procedure Code, was initially targeted for completion in September. However, lawmakers are still accommodating feedback from the public to ensure the new procedural code aligns with the recently enacted Criminal Code (KUHP), which will take effect on January 1, 2026.
“Every time we move toward enacting the KUHAP, there is public participation that must be heard,” said Dasco, a Gerindra Party politician. “If there are no further inputs in the near future, it will be enacted, and then we can proceed with the Asset Forfeiture Bill.”
According to Dasco, the DPR’s Expert Body is currently compiling regulations on asset seizure scattered across various laws, including the Anti-Money Laundering Law, the Corruption Law, the Criminal Code, and the KUHAP. The goal is to update the Asset Forfeiture Bill so that it aligns with existing legislation.
“They must not contradict one another,” he stressed, adding that proper synchronization will strengthen the bill’s legal standing. Without it, Dasco warned, the bill could face challenges in court. “If there are inconsistencies, it will be vulnerable during the legal process,” he said.
The government and the DPR previously agreed to include the Asset Forfeiture Bill in the 2025 priority national legislative program. However, the DPR has yet to determine which body will take the lead in discussing it.
DPR Legislative Body Chair Bob Hasan earlier stated that the Asset Forfeiture Bill will be drafted in parallel with the KUHAP revision. He underscored that the procedural law must be finalized because it serves as the foundation for asset seizure regulations.
“Since asset forfeiture involves legal action and events tied to criminal proceedings, it cannot be separated from criminal procedural law. That’s why the stages must run in parallel,” said Bob, also a Gerindra Party politician, at the Parliament Complex in Senayan, Jakarta, on Tuesday, September 9, 2025.
