TEMPO.CO, Jakarta - A criminal law expert from Gadjah Mada University (UGM), M. Fatahillah Akbar, commented on the alleged corruption in the management of crude oil and refinery products at state-owned oil and gas firm Pertamina during the period of 2018-2023.
This corruption has caused a loss to the state amounting to Rp193.7 trillion.
Fatahillah stated that this case has caused two types of losses: to the state finances and to the national economy. The state finances suffered due to price markups, while the national economy was affected by the domino effect on society.
"The loss to the national economy should be assessed by economic experts," Fatahillah told Tempo on Wednesday, February 26, 2025.
He mentioned that this corruption case has harmed the wider public. Many vehicles were damaged because they received fuel that did not meet the specified octane value. They should have received RON 92 (Pertamax) but instead got RON 90 (Pertalite).
"People can now file for compensation claims, which may also be combined with criminal charges," said Fatahillah.
He explained that those who feel aggrieved can pursue a class action lawsuit through civil proceedings.
"Article 99 of the Criminal Procedure Code permits the integration of civil lawsuits within criminal cases. This can be coordinated with the Attorney General," Fatahillah added.
In this case, the Attorney General has named suspects including Riva Siahaan as the President Director of PT Pertamina Patra Niaga; Sani Dinar Saifuddin as the Director of Feedstock and Product Optimization at PT Kilang Pertamina Internasional; Yoki Firnandi as the President Director of PT Pertamina International Shipping, and Agus Purwono as the VP Feedstock Management of PT Kilang Pertamina Internasional.
Other suspects are Muhammad Kerry Andrianto Riza as the beneficial owner of PT Navigator Khatulistiwa, DW as the Commissioner of PT Navigator Khatulistiwa and at the same time the Commissioner of PT Jenggala Maritim, and GRJ as the Commissioner of PT Jenggala Maritim and President Director of PT Orbit Terminal Merak.
Investigators from the Attorney General's Office found indications that the suspects deliberately manipulated domestic refinery oil production policies to decrease output, thus necessitating a large volume of imports.
However, according to the applicable regulations, domestic crude oil supply should be prioritized before imports.
"The suspects conditioned the downstream optimization meeting results to reduce refinery readiness, leading to rejection of domestic contractor crude oil and ultimately pushing imports," said Head of the Legal Information Center of the Attorney General's Office, Harli Siregar, on Monday, February 24, 2025.
The Attorney General's Office stated that in the procurement of refinery products by Pertamina Patra Niaga, Riva made purchases or payments for RON 92 fuel although in reality, he bought RON 90 or lower. From this purchase, blending was then carried out at storage or depots to produce RON 92.
