TEMPO.CO, Jakarta - Attorney General Sanitiar Burhanuddin has entrusted 200,000 hectares of land, seized in the Duta Palma Group corruption case, to Minister of State-Owned Enterprises (SOE) Erick Thohir.
"We will hand it over to the SOE Minister so that these assets are maintained," said Burhanuddin, at the Main Building of the Attorney General's Office, on Tuesday, February 18, 2025.
Burhanuddin stated that this transfer was done to preserve the value of the seized land and prevent its depreciation. In addition, the 200,000 hectares of land is also expected to generate profits for the government, especially for the people who depend on PT Duta Palma.
The SOE Ministry, led by Erick Thohir, was chosen to manage the land because it is deemed the appropriate state institution to handle the company. However, Burhanuddin stated that this decision is not yet final, and until now, the land is still managed by PT Duta Palma.
SOE Minister Erick Thohir stated that the management of the seized land by his ministry aims to prevent losses to the community, including employees of PT Duta Palma. It also prevents the seized assets from being sold illegally, both domestically and internationally, which could occur due to a lack of management.
"We are not improvising on the company's performance, but instead, our focus is on how to maintain the recovery of these assets," said Erick.
In this corruption case, Duta Palma boss Surya Darmadi was named a suspect for allegedly grabbing 37,095 hectares of oil palm land in Indragiri Hulu Regency, Riau. His company, Duta Palma Group, cultivated this land without permission from 2003 to 2022.
The case began when the Regent of Indragiri Hulu in 1999-2008, Raja Thamsir Rachman, issued location and plantation permits (IUP) to four Duta Palma Group companies: PT Banyu Bening Utama in 2003, PT Panca Argo Lestari, PT Palma Satu, and PT Sebrida Subur in 2007.
The issuance of these permits is suspected to be illegal and potentially caused losses to the state as the land is located within a forest area, and without the release of the forest area.
Surya Darmadi's legal representative, Juniver Girsang, hoped that the judges would decide proportionally. According to him, the case against his client is not eligible for trial as it has been accommodated by the Omnibus Law.
"The indictment questioned by the Attorney General is about forest area. But this issue has been accommodated by the Omnibus Law," he said on Wednesday, February 22, 2023.
Former Regent of Indragiri Hulu, Raja Thamsir Rachman, was sentenced to 10 years in prison and a fine of Rp1 billion or six months substitute imprisonment. However, the Corruption Court judges later reduced his sentence to 7 years in prison and a fine of Rp200 million.
The Attorney General named Surya Darmadi as a suspect on August 1, 2022, for alleged land grabbing. He reportedly ignored the Attorney General's three summons after being named a suspect.
On September 19, 2023, the Supreme Court reduced the compensation the boss of PT Darmex Group and PT Duta Palma was required to pay to only Rp2 trillion from the original Rp42 trillion. However, in this cassation decision, his prison sentence was increased by one year to 16 years.
