Tangerang Sea Fence No Longer Mysterious, Aguan Company Controls Majority of HGB Owners' Shares There

TEMPO.CO, Jakarta - The owner of the sea fence in Tangerang, Banten is no longer a mystery. According to data from Indonesia's Ministry of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN), there are two companies that own the Building Use Rights (HGB) certificates for the 30.16-kilometer sea fence in the waters of Tangerang. So, which company is the mastermind behind the sea fence?

Quoted from Antara, the sea fence in Tangerang is controlled by the company PT Intan Agung Makmur which has 234 HGB certificates and PT Cahaya Inti Sentosa with 20 plots. Not only owned by the two companies, the certificates are also owned by individuals, namely nine plots and Land Ownership Certificates (SHM) for 17 plots. In total, the number of sea fences in Tangerang that have HGB certificates is up to 263 plots.

Based on data from the Directorate General of General Legal Administration (AHU) of the Ministry of Law (Kemenkum), the two companies have been legally registered under the law. PT Intan Agung Makmur was authorized by the Directorate General of AHU, Ministry of Law and Human Rights based on Decree (SK) Number AHU-0040990.AH.01.01.Year 2023 issued on June 7, 2023.

The company is registered as a national private company with an unlimited term and closed status. PT Intan Agung Makmur itself has a real estate business activity with the Indonesian Standard Business Classification (KLBI) code 68111. The company's authorized capital is listed at Rp5 billion, all of which has been paid in cash.

The company's shares are owned by two entities, namely Kusuma Anugrah Abadi and Inti Indah Raya, which each have 2,500 shares totaling Rp2.5 billion. The company is led by Belly Djaliel as director and Freddy Numberi as commissioner. Freddy is a retired TNI AL with the rank of Marshal Madya. He was once the Governor of Papua in 1998 after retiring.

Meanwhile, PT Cahaya Inti Sentosa was authorized by the Directorate General of AHU, Ministry of Law and Human Rights based on Decree (SK) Number AHU-0078522.AH.01.02.Year 2023 issued on December 14, 2023. The type of the Company is listed in the form of non-facility domestic investment (PMDN) with an unlimited period and closed status. The Company's authorized capital is recorded at Rp356.4 billion, but the issued and paid-up capital is worth Rp89.1 billion.

In accordance with the company's deed, the shareholders of PT Cahaya Inti Sentosa are PT Pantai Indah Kapuk Dua (PANI), PT Agung Sedayu, and PT Tunas Mekar. Agung Sedayu Group owned by Sugianto Kusuma or Aguan and Salim Group owned by Anthoni Salim are shareholders in PANI. PT PANI owns 88,500 shares or worth Rp88 billion.

Then PT Agung Sedayu and PT Tunas Mekar Jaya each have 300 shares worth Rp300 million in Cahaya Inti Sentosa. Furthermore, the shareholders of PT Intan Agung Makmur are Kusuma Anugrah Abadi and Inti Indah Raya each with 2,500 shares worth Rp2.5 billion.

The company's management includes Nono Sampono as president director, Kho Cing Siong as president commissioner, Belly Djaliel, Surya Pranoto Budiarjo, and Yohanes Edmond Budiman as directors, and Freddy Numberi as commissioner. Nono Sampono was once Deputy Chairman of the DPD RI for the 2017-2024 period. This retired Indonesian Navy (AL) with the rank of lieutenant general (Marine) was once the Commander of Paspampres.

Regarding his involvement, the company owned by tycoon Aguan claims to have obtained a certificate according to procedure. "The SHGB above is in accordance with the process and procedure. We buy from the people SHM (ownership certificate)," said Agung Sedayu Group's attorney, Muannas Alaidid on Friday, January 24, 2025 as quoted by Antara.

He explained that the SHGB in the name of his subsidiary did not cover the entire area of the 30.16-kilometer sea fence. According to Muannas, the HGB-certified sea fence owned by Agung Sedayu's subsidiary is only in Kohod Village, Pakuhaji District, Tangerang Regency.

"The sea fence does not belong to PANI (Pantai Indah Kapuk 2 Tbk), of the 30 km of sea fence, the ownership of the SHGB of the subsidiaries PIK PANI and PIK Non PANI is only in Kohod Village, Pakuhaji District, in other places it is certain that there is none," he said.

He said that with the ownership of the Building Use Rights Certificate behind the official name, his party had paid taxes and was listed in the SK for the Location Permit/PKKPR. "Change the official name, pay taxes and have a Location Permit/PKKPR letter," he said.
