TEMPO.CO, Jakarta - The Secretary General of the Central Governing Council of the Indonesian Democratic Party of Struggle Hasto Kristiyanto has been charged with obstructing the investigation of a corruption case involving Harun Masiku as a suspect from 2019 to 2024.
KPK Prosecutor Wawan Yunarwanto stated that Hasto obstructed the investigation by instructing Harun, through his Home Aspiration guard Nur Hasan, to drop Harun's mobile phone in water after the KPK caught 2017-2022 KPU member Wahyu Setiawan red-handed.
"Hasto also ordered his aide, Kusnadi, to submerge the phone as a precaution against possible seizures by KPK investigators," the prosecutor said while reading the indictment at the Jakarta Corruption Court on Friday, March 14, 2025.
In addition to obstructing the investigation, Hasto, together with lawyer Donny Tri Istiqomah, former convict in the Harun Masiku case, Saeful Bahri, and Harun Masiku, has allegedly given a sum of 57,350 Singapore dollars or around Rp 600 million to Wahyu in the 2019-2020 period.
The money was allegedly given with the purpose of persuading Wahyu to urge the KPU to approve the replacement of Elected Legislative Candidate for the South Sumatra Electoral District (Dapil) I for the 2019-2024 period, Riezky Aprilia, to Harun Masiku.
Thus, Hasto faces charges as stipulated in Article 21 and Article 5 Paragraph (1) letter a or Article 13 of the Corruption Eradication Law juncto Article 65 Paragraph (1) of the Criminal Code and Article 55 Paragraph (1) Ke-1 jo. Article 64 Paragraph (1) of the Criminal Code.
The prosecutor revealed that the case began when KPK officers, on January 8, 2020, received information about communication between Wahyu and former convict of the bribery case involving Harun Masiku's replacement, Agustiani Tio Fridelina, who conveyed the acceptance of money.
The money recipient is allegedly related to the plan to appoint Harun as an elected DPR member for the 2019-2024 period, prompting KPK officers to monitor the movements of the suspected parties, namely Wahyu, Harun, Saeful, Donny, and Agustiani.
Some time later, KPK officers successfully apprehended Wahyu at Soekarno-Hatta Airport, Tangerang. At around 18:19 WIB, Hasto received information that Wahyu had been detained by the KPK officers.
Subsequently, Hasto, through Nur Hasan, instructed Harun Masiku to drop his mobile phone in water and ordered Harun to wait at the Central Governing Council (DPP) office of the Indonesian Democratic Party of Struggle in order to avoid being located by the KPK officers.
At around 18.35 WIB near the Hotel Sofyan Cut Mutia in Jakarta, Harun met with Nur Hasan. Following Hasto's instructions and with Nur Hasan's assistance, at 18:52 WIB, Harun's mobile phone became inactive and untraceable.
Next, KPK officers monitored Harun Masiku's whereabouts through the mobile phone position updates of Nur Hasan, who was observed at 20.00 WIB together with Harun at the Police Science College (PTIK). At the same time, Kusnadi, as Hasto's confidant, was also observed at PTIK.
"The KPK officers then went to PTIK, but failed to find Harun Masiku," said the public prosecutor.
In addition to Harun's mobile phone, the prosecutor mentioned that Hasto also allegedly instructed Kusnadi to submerge his own mobile phone on June 6, 2024, as a precaution against forced attempts by KPK investigators during the summons for Hasto's testimony in the Harun Masiku case on June 4, 2024.
In following Hasto's order, Kusnadi carried it out. Then, on June 10, 2024, Hasto and Kusnadi attended the summons as witnesses at the KPK.
Prior to being questioned as a witness, the public prosecutor recounted that Hasto entrusted his mobile phone to Kusnadi, but when the KPK investigators asked about Hasto's mobile phone, he claimed not to have one.
Based on information obtained by the KPK investigators, it was revealed that Hasto's mobile phone was entrusetd to Kusnadi, leading the investigators to seize the mobile phones of Hasto and Kusnadi, but they did not find Kusnadi's mobile phone containing information related to Harun Masiku.
