TEMPO.CO, Jakarta - Constitutional Court (MK) Judge Enny Nurbaningsih has stated that the court will still accept reports of election disputes even if they are submitted after the registration deadline. The deadline is set for January 3, 2025.
"MK cannot reject cases that are submitted, even if they are submitted after the January 3 deadline," Enny said via WhatsApp on Friday, December 20.
The reason MK is open to receiving late reports, she said, is because they are still not sure whether all regional general election commissions (KPUs) have completed the vote count. "Therefore, disputes will be accepted even after the deadline," she said.
Enny, a lecturer in constitutional law, explained that the registration phase for disputes, which will be documented in the Constitutional Case Registration Book (BPRK), will be held only once. However, there will be an opportunity to submit election disputes after the established schedule.
"The parties involved will handle the cases accordingly," she said.
Meanwhile, Gadjah Mada University (UGM) constitutional law expert Yance Arizona said the court would evaluate cases submitted after the registration deadline on a case-by-case basis to decide whether to proceed to the review stage. "Ultimately, it will be up to the RPH (Judicial Deliberation Meeting) to make that decision," Yance said via WhatsApp.
The Constitutional Court opened the registration period for submitting disputes regarding the 2024 regional elections on November 27. According to Constitutional Court Regulation No. 4/2024 on the Stages, Activities and Schedule for Handling Election Dispute Cases for the Elections of Governors, Regents and Mayors, the deadline for submitting election dispute applications was Wednesday, December 18, 2024.
At the close of the filing period, the mkri.id website recorded 307 election dispute reports. As of 14:23 today, three additional disputes have been submitted, bringing the total number of reports to 310.
