TEMPO.CO, Jakarta - The legal case involving the General Secretary of PDIP, Hasto Kristiyanto, continues. After Hasto's pretrial motion was dismissed by the South Jakarta District Court on Thursday, February 13, 2025, he is now filing a second one.
"We have filed two pretrial motion requests based on the judge's verdict on February 13, 2025," said Hasto's legal representative, Ronny Talapessy, in a written statement on Monday, February 17.
Ronny stated that the filing of the pretrial motion is a follow-up to the previous pretrial decision that rejected Hasto's request.
During the hearing, sole judge Djuyamto stated that Hasto should have filed two pretrial requests for the two investigation orders that became the basis for appointing the PDIP chief a suspect.
"The judge believes that the applicant's pretrial request is inadmissible," said Djuyamto while reading the pretrial verdict at the South Jakarta District Court on Thursday, February 13, 2025.
Here is a summary of the latest information regarding the facts in the Hasto Kristiyanto case.
Request to Postpone Probe
In connection with the filing of the pretrial motion, Ronny stated that they had submitted a request for postponement of the probe for Hasto Kristiyanto.
"This is related to re-filing a pretrial motion at the South Jakarta District Court as a follow-up to the previous pretrial decision," said Ronny.
KPK spokesperson Tessa Mahardhika confirmed that the agency has scheduled a probe for Hasto. Hasto is being examined as a suspect for obstructing an investigation and bribery involving former General Election Commission (KPU) Commissioner Wahyu Setiawan, which also implicated fugitive Harun Masiku.
"It is true that Mr. HK was summoned today in his capacity as a suspect," said Tessa Mahardhika in a brief message on Monday, February 17, 2025.
KPK Will Send a Second Summons
The Corruption Eradication Commission (KPK) will send a second summons to Hasto Kristiyanto, after the PDIP Secretary-General filed a request for postponement of the examination on Monday, February 17, 2025. Tessa mentioned that the re-summoning of Hasto will take place on Thursday or Friday this week.
"The investigators will re-send a second summons to the concerned person, still within this week," said Tessa to reporters at the KPK Red and White Building, South Jakarta, on Monday.
According to Tessa, the pretrial process is different from the investigation process handled by law enforcement officers. Thus, investigators believe that there is no reason for Hasto not to attend the summons as a suspect today.
PDIP States There is Still Room for Resistance
Regarding Hasto's filing of a second pretrial motion, PDIP spokesperson Guntur Romli stated that the action was taken because there is still room for resistance that can be done by the party against the case.
"Because there is still room for resistance through the pretrial legal route," said Guntur when contacted on Monday, February 17, 2025.
According to him, the legal case entangling Hasto is an attempt to disrupt PDIP's internal affairs through the anti-graft agency.
KPK Leaders Ask Hasto to Fulfill KPK's Summons
KPK Deputy Chair Johanis Tanak stated that there is no prohibition on filing a request for a probe postponement. Nevertheless, he emphasized that anyone who is summoned for questioning is obligated to attend to facilitate the investigation process.
"The concerned party is obliged to attend the summons to facilitate the investigation process, even though the suspect is filing a pretrial request," said Tanak via the WhatsApp application on Monday, February 13, 2025.
According to Johanis Tanak, an exception can only be given if the pretrial judge decides to temporarily halt the investigation until a decision is made.
KPK Deputy Chair Fitroh Rohcahyanto stated that Hasto's request is still being reviewed by the investigators. "The investigators will review to determine the necessary steps," he said when contacted on Monday, February 13, 2025.
