Prabowo Slams Judges for Lenient Sentence in Massive Corruption Case

TEMPO.CO, JakartaPresident Prabowo Subianto has called for an internal cleansing within law enforcement agencies before being cleaned up by the public, warning that public dissatisfaction could force action. He emphasized that the Indonesian people are not stupid.

Prabowo urged judges to deliver appropriate sentences, particularly in cases of corruption. He argued that when clear violations occur, resulting in trillions of rupiah in state losses, the judge should not impose a light sentence.

“[People] might say that Prabowo does not know the law,” during the Development Planning Conference (Musrenbang) at Bappenas on Monday, December 30, 2024.

He asserted that the public understands the gravity of such matters. He pointed out that when corruption involving hundreds of trillions of rupiah is met with light sentences, the public suspects that convicted individuals are enjoying comfortable prison conditions, complete with amenities like air conditioning and refrigerators.

“Please, the Minister of Corrections, the Attorney General, file an appeal. It should be about 50 years [imprisonment],” the President implored. “Let's all return to our identity on August 17, 1945, the ideals of our nation's founders.”

While Prabowo did not explicitly name the corruption case in question, his statement comes amid intense controversy surrounding the verdict against Harvey Moeis. Harvey was implicated in a corruption case related to tin commodity trade management, resulting in an estimated Rp300 trillion in losses to the state. 

In a verdict delivered on December 23, 2024, the Corruption Court sentenced Harvey to 6 years and 6 months in prison and ordered him to pay Rp210 billion in compensation. Failure to recover this amount from his assets would result in an additional 2-year prison term. 

The panel of judges, chaired by Eko Ariyanto with members Suparman Nyompa, Eryusman, Jaini Basir, and Mulyono, delivered a sentence significantly lighter than the prosecution's demand of 12 years in prison, a Rp1 billion fine, and Rp210 billion in compensation. The 6.5-year sentence given to defendant Harvey Moeis in the alleged corruption within the PT Timah Tbk Mining Business Permit area is widely considered to set a damaging precedent for future corruption cases.

“This verdict is certainly disappointing because it will not have a deterrent effect on other perpetrators of corruption,” stated former Corruption Eradication Commission (KPK) investigator Yudi Purnomo Harahap when contacted on Sunday, December 29, 2024.

Yudi argued that the 6.5-year sentence is far too lenient for a crime that caused Rp300 trillion in state losses. He believes the sentence delivered by Chief Judge Eko Ariyanto failed to deliver a sense of justice to the public.

“Even though his role was very small, he is still a perpetrator of corruption,” Yudi protested. The member of the National Police Corruption Prevention Task Force emphasized that regardless of the scale of Harvey's involvement, corruption is an extraordinary crime.

Yudi further underlined that Harvey should not have received such a light sentence, especially given that he did not act as a justice collaborator by exposing further corruption within the PT Timah Tbk 2015-2022 IUP area. As an extension of PT Refined Bangka Tin (RBT), Yudi believes Harvey deserved the 12-year sentence demanded by the prosecutor.
