Govt Weighs Freeport Export Permit; Decision Pending, Hinges on Smelter Completion

TEMPO.CO, Jakarta - The government is still reviewing the possibility of granting an export permit for PT Freeport Indonesia concentrate. This decision will depend on a comprehensive evaluation and discussions during the limited meeting proposed by the Coordinating Ministry for Economic Affairs.

Several factors are being considered in the government’s policy determination, including the status of the force majeure. "For instance, in the case of an accident, whether the police determine it was truly unintentional or if other factors caused the cessation of activities," Yuliot said during an interview at his office on Friday, February 14.

Additionally, the government is evaluating the potential impact of halting activities in the upstream mining sector. "We need to ensure that there is no total suspension of mining activities, as this would affect both state and regional revenues," he added.

Yuliot revealed that the Coordinating Ministry for Economic Affairs has tasked both the Ministry of Energy and Mineral Resources (ESDM) and the Ministry of Trade to assess the situation before considering the possibility of granting the export permit.

Although rumors suggest that Freeport will resume exporting concentrate by the end of this month, the government emphasized that no official decision has been made. The meeting is not scheduled yet. The proposal for the meeting came from the Coordinating Ministry for Economic Affairs," he said.

Under the law, concentrate exports are subject to restrictions, meaning that any policy regarding this matter must go through discussions between multiple ministries. The final decision will be made during a coordination meeting with the President

Bahlil: Smelter Completion a Prerequisite for Export Permit

Minister of Energy and Mineral Resources Bahlil Lahadalia revealed that Freeport has requested an extension for its concentrate export permit. However, he emphasized that approval will only be granted if the company can provide assurances regarding the completion of the smelter repairs.

"We have asked them to immediately discuss the completion date of their smelter, especially for sulfuric acid production," Bahlil said during the Mandiri Investment Forum at Fairmont Jakarta on Tuesday, February 11.

Bahlil urged that the completion schedule for the damaged smelter, particularly the sulfuric acid production section, be discussed promptly. "Once that’s done, we will request a faster resolution to present it in the meeting with the ministers and report it to the President," he explained.

Based on the Minister of Energy and Mineral Resources Regulation No. 7 of 2023, the export permit for Freeport's copper concentrate expired on December 31, 2024.
