TEMPO.CO, Jakarta - The Government of the Republic of Indonesia is currently studying a letter from the French government regarding the transfer of death row convict Serge Areski Atlaoui to his home country. The French government, through the Minister of Justice, has sent an official letter addressed to the Indonesian Minister of Immigration and Corrections on Thursday.
"We are coordinating and studying it," said Coordinating Minister for Law, Human Rights, Immigration, and Corrections Yusril Ihza Mahendra, Sunday, December 29, 2024.
According to Yusril, the Indonesian government will further discuss the letter from the French government signed by the Head of the Office of International Mutual Legal Assistance in Criminal Matters Stephanie Djian in early January 2025.
"A more detailed discussion will be carried out by officials under the minister by the Indonesian government. Likewise, the French Ministry of Justice may also involve staff from the French Embassy in Jakarta," he said.
Later, Yusril continued, Serge Atlaoui's transfer will be carried out based on a practical arrangement agreement, as with the transfer of death row convict Mary Jane Veloso to the Philippines and five Bali Nine members to Australia in early December.
French Ambassador to Indonesia Fabien Penone had previously visited Coordinating Minister Yusril at the Coordinating Ministry for Law and Human Rights Imipas Office, Jakarta, last Friday. After the meeting, Yusril explained that the French government had not sent an official letter to transfer Serge Atlaoui.
He said that the request for transfer had only been submitted personally by Serge Atlaoui to the French government. The transfer of foreign prisoners is a cooperation between countries so that the discussion must be based on an official letter from the government concerned.
At the bilateral meeting, the Indonesian and French governments had not exchanged drafts of cooperation on the transfer of Serge Atlaoui. According to Yusril, his meeting with Fabien Penone discussed the legal conditions in both countries.
Serge Atlaoui was sentenced to death in the case of operating an ecstasy factory in Cikande, Tangerang, Banten in 2005. He has repeatedly applied for clemency from the Indonesian government, but the efforts have failed.
Serge Atlaoui's execution in 2015 was postponed so that the French citizen is still languishing in prison. Yusril explained that Serge Atlaoui was recently temporarily transferred from Nusakambangan to Salemba Penitentiary, because he has cancer.
