Komnas HAM Submits Human Rights Agenda to Prabowo-Gibran Government

TEMPO.CO, Jakarta - The National Commission on Human Rights (Komnas HAM) has outlined several critical human rights agendas for the Prabowo-Gibran government to address. These priorities include resolving conflicts and violence in Papua, fulfilling the rights of victims of serious human rights violations, and developing the Nusantara Capital City (IKN) based on human rights principles.

Regarding the resolution of conflicts and violence in Papua, Komnas HAM Chairperson Atnike Nova Sigiro emphasized the urgency of government action. The ongoing conflict and violence in Papua have resulted in casualties among both civilians and law enforcement officers.

“This situation has caused social vulnerabilities that impede the enjoyment and protection of human rights, such as difficulties in law enforcement against perpetrators of violence, internal displacement, and hindered access to economic, social, and cultural rights like education, health, and employment,” Atnike said on Tuesday, October 22, 2024.

The agenda of fulfilling the rights of victims of serious human rights violations is equally important, according to Atnike. On January 11, 2023, President Jokowi acknowledged 12 cases of serious human rights violations and expressed regret for their occurrence.

“The government is committed to taking steps for recovery and preventing the recurrence of such events and has assigned 19 ministries/agencies to follow up on these commitments. Recovery programs, such as health, education, economy, and the restoration of citizens' rights, have been implemented but remain insufficient in addressing the needs of the identified victims,” Atnike noted.

The government must also prioritize efforts to prevent the recurrence of past human rights violations. Therefore, Atnike stressed the importance of continued recovery programs and a more comprehensive and sustainable approach to fulfilling the rights of victims.

Additionally, several cases of serious human rights violations investigated by Komnas HAM have yet to receive adequate follow-up. “The government needs to facilitate efforts to provide clarity regarding the status of these cases,” she urged.

One of the stalled cases is the Paniai case, where the cassation trial process was suspended due to the absence of selected ad hoc cassation judges.

Another crucial agenda is the development of IKN based on human rights principles. Komnas HAM's study identified several issues in the planning and development of the new capital city, including a lack of participation, the absence of complaint mechanisms, and inadequate community recovery.

“During the ongoing development of IKN, several violations, such as violence against residents and the loss of community access to welfare rights, have occurred and been reported to Komnas HAM. The risk of future human rights violations in IKN's development must be continually anticipated,” Atnike warned.

Therefore, Atnike believes it is essential to establish an effective monitoring mechanism to mitigate implementation risks and implement a recovery mechanism to address the risks and impacts of IKN development on human rights.
