TEMPO.CO, Jakarta - The legal team representing former trade minister Tom Lembong plans to file a pretrial motion to challenge the Attorney General's Office's decision to designate their client as a suspect in a corruption case involving sugar imports during his tenure from 2015 to 2016.
Tom's legal representative, Ari Yusuf Amir, said that his team had prepared the lawsuit. “Since taking on the case, we have been diligently gathering evidence to support our pretrial motion,” he stated during a press conference at his office in Setiabudi, South Jakarta, on Monday, November 4, 2024.
The pretrial motion will argue that the Attorney General's Office did not adhere to proper legal procedures when designating Tom as a suspect. According to Ari, investigators should present two pieces of evidence to a suspect and clearly explain their basis for the designation. However, the Attorney General's Office has yet to provide specific details about the evidence used to implicate Tom.
Ari also questioned the timeline of the alleged corruption, which spans from 2015 to 2023, while Tom Lembong's term as Trade Minister ended in 2016.
“Given these irregularities, we are seriously considering filing a pretrial motion,” Ari affirmed.
However, Ari stopped short of disclosing the exact timing of the pretrial filing. “We cannot determine the timing at the moment, but we will soon announce it,” he added.
Following the suspect designation on Tuesday, October 29, 2024, Tom Lembong was detained by the Attorney General's Office for 20 days. He is currently being held at the Salemba detention center of the South Jakarta District Attorney's Office.
