3 Defendants of Extortion in KPK Detention Center Reject Compensation Demand

TEMPO.CO, Jakarta - Three defendants of corruption involving extortion in the Corruption Eradication Commission's Detention Center (KPK Detention Center), namely Suharlan, Ricky Rachmawanto, and Ramadhan Ubaidillah, refused to pay compensation as demanded by the public prosecutor. This was revealed in the defense plea or plea statement by the legal counsel of Suharlan, Ricky, and Ramadhan.

"We firmly reject the demand for compensation because it is not included in the KPK prosecutor's indictment," said the legal counsel of Suharlan, Ricky, and Ramadhan during a trial at the Jakarta Corruption Court on Monday, December 2, 2024.

The defendants' legal counsel stated that, according to the Criminal Procedure Code (KUHAP), the public prosecutor is not allowed to create a demand letter that deviates from the indictment. The demand letter must be based on facts presented in the trial and those contained in the indictment. Therefore, he requested the public prosecutor to ensure consistency between the indictment and the demand, unless there are changes to the indictment approved during the trial.

"Thus, if the public prosecutor's demand does not match the indictment, then it is appropriate for the Honorable Panel of Judges to dismiss the demand letter and consider a decision relevant to the indictment," said the defendants' legal team.

Previously, the KPK public prosecutor demanded a 4-year prison sentence for Suharlan, Ricky Rachmawanto, and Ramadhan Ubaidillah. The public prosecutor also demanded prison officials involved in extorting the KPK detainees to pay a fine of Rp250 million or serve 6 months in prison if unable to pay the fine.

In addition to the three defendants, there are 12 other defendants in this case. The 15 defendants are suspected of carrying out corruption in the form of extortion in the KPK Detention Center amounting to Rp6.38 billion between 2019-2023.

The extortion took place in three detention centers owned by the anti-corruption institution. The centers are the KPK Detention Center at Pomdam Jaya Guntur, the KPK Detention Center at Building C1, and the KPK Detention Center at Building Merah Putih (K4).
