TEMPO.CO, Jakarta - TikTok's fate in the United States will be decided on January 10, 2025. The United States Supreme Court will hear arguments from its Chinese-based parent company, ByteDance, to stop a law that threatens the survival of the application.
The rule signed by President Joe Biden in April requires ByteDance to sell TikTok to an American entity by January 19, 2025, or the application will be blocked on the pretext of national security. TikTok, which is used by 170 million Americans, has filed an emergency request on December 16, 2024. The company alleges that this rule violates the First Amendment to the United States Constitution.
"We believe the court will find that the TikTok ban is unconstitutional, so that the more than 170 million Americans on our platform can continue to exercise their free speech rights," TikTok said in a statement, quoted by Reuters, Saturday, December 21, 2024.
Meanwhile, the Department of Justice called TikTok a 'very serious national security threat'. The reason is, this application's access to American user data, such as location and private messages. In addition to the potential for covert content manipulation. TikTok has strongly denied these allegations, calling the concerns unsubstantiated speculation.
If the ban goes into effect, TikTok estimates the impact will be devastating for the company. "In just one month, we could lose a third of our users in the United States," they said. This is considered to reduce TikTok's appeal to advertisers, content creators, and potential employees.
Republican Senate Leader Mitch McConnell supports the ban. In his brief, he likened TikTok to a hardened criminal. However, President-elect Donald Trump, who will take office the day after TikTok's deadline, has a different take. "I have a warm feeling for TikTok and will be looking into this issue," Trump said on December 16.
Amid this dispute, TikTok has emphasized the importance of freedom of choice for American users. "If Americans, who have been informed about the risks of alleged 'covert' content manipulation, choose to continue to view content on TikTok in good faith, the First Amendment gives them the right to make that choice without government censorship," they said.
This polemic occurs amid increasingly tense trade relations between the United States and China. TikTok hopes the Supreme Court will overturn the ban and uphold the US tradition of protecting free speech and open internet access.
