Rights Groups Criticize Transfer of Andrie Yunus Case to Military

TEMPO.CO, Jakarta The police have transferred the investigation of the acid attack case on human rights activist Andrie Yunus to the Central Military Police of the Indonesian National Armed Forces or Puspom TNI. This was stated by the Director of General Crimes of the Jakarta Metropolitan Police, Commissioner Iman Imanuddin, during a meeting with the Commission III of the People's Representative Council (DPR) on Tuesday, March 31, 2026.

The Advocacy Team for Democracy (TAUD) expressed disappointment with the transfer of a life-threatening case to the military institution. The Chair of the Indonesian Legal Aid Institute (YLBHI) Muhammad Isnur stated that the police should not have stopped the investigation process with just two field actors.

According to an initial finding by an independent civil society investigation team, at least 16 individuals are suspected to be involved in the acid attack on Andrie Yunus on March 12.

"(The police) have not at all revealed who ordered the attack, the intellectual author, who financed it, and its operations," said Isnur at the DPR complex after the meeting with Commission III, Jakarta on Tuesday, March 31, 2026.

Isnur stated that the transfer of Andrie Yunus' case to the TNI Puspom is erroneous and legally flawed due to the lack of regulatory basis behind it. Especially since there is no memorandum of understanding (MoU) regarding this case transfer.

"The police should immediately hand over the investigation to the prosecutor's office if there is an ongoing investigation," he added.

He mentioned that the police investigators reported to the Prosecutor's Office by issuing an order to start the investigation. He stated that this mechanism is already regulated in the new Criminal Procedure Code.

"The Prosecutor's Office will conduct the examination. Then it will be determined whether there is a connection or not," said Isnur.

The Director of the Jakarta Legal Aid Institute, Fadhil Alfathan, explained that there is nothing justifying the transfer of Andrie Yunus' case from the police to the military. Even if the investigators at TNI Puspom find that an active-duty soldier committed a criminal act against a civilian.

"The new Criminal Procedure Code places the police as the primary investigators," said Fadhil on Tuesday, March 31, 2026.

He added that the transfer of the Andrie Yunus investigation demonstrates the fragility of the criminal justice system. He emphasized that there should have already been a public prosecutor involved in the investigation of the acid attack on the Coordinator Deputy of KontraS.

However, he pointed out that there is currently a clear coordination chaos when the police transferred the investigation to TNI Puspom. "The dominus litis should actually be at the Prosecutor's Office. It's the prosecutor who decides," said Fadhil.

He expressed disappointment with the lack of firm opposition from the DPR Commission III regarding the transfer of Andrie Yunus' case. He stated that the transfer of the investigation from the police to the military has implications for the damage to the criminal justice system in Indonesia.

Muhammad Isnur suspects there are psychological and political obstacles in the disclosure of Andrie Yunus' case by the police. Therefore, he urged the government to immediately form an independent Joint Fact-Finding Team (TGPF) to help fully uncover the case. "In the experience of uncovering the Munir case, for example, the TGPF was able to expose it all," said Isnur.
