Tangerang Sea Fence Dismantled, What About the One in Bekasi?

TEMPO.CO, Jakarta - The presence of sea fences in Tangerang and Bekasi waters have stirred public interest recently, as the two sea fences were erected without proper permits.

In Tangerang Regency waters, the barrier was made of thousands of bamboo stakes, stretched for 30.16 kilometers. The latest news is that the Indonesian Navy (TNI AL), tasked with the demolition, completed the process on Thursday, February 13, 2025.

"Today, 1.36 kilometers of the seawall remains, which we have successfully demolished. The entire area is now clear, and thankfully, the weather was quite sunny. Today marks the conclusion of the sea fence dismantlement process," said the Commander of the Marine Corps (Danpasmar), Brigadier General Hermanto at Tanjung Pasir Beach, Tangerang Regency, on Thursday.

So, how about the sea fence dismantling in Bekasi?

The sea fence in Bekasi waters consists of a stretch of bamboo poles, 3.3 kilometers long and 70 meters wide, spanning the waters of Segarajaya Village, Tarumajaya District. The sea fence forms a long line resembling an embankment, with a water expanse in the middle resembling a river.

This sea fence was established as a result of cooperation between the West Java Maritime and Fisheries Agency (DKP) and PT Tunas Ruang Pelabuhan Nusantara (TRPN) to arrange the shipping channel at the Paljaya Fish Landing Port (PPI) area.

However, the Ministry of Maritime Affairs and Fisheries (KKP) stated that the sea fence did not have the required Permit for the Utilization of Marine Space (PKKPRL).

PT TRPN identified as the culprit

The Directorate General of Marine and Fisheries Resources Surveillance (PSDKP) has determined that PT TRPN engaged in illegal reclamation.

They found that the installation of the barrier had a negative impact on the marine ecosystem, narrowed the fishing areas, disadvantaged fisher and cultivators, and disrupted the operations of the Banten 03 Steam Power Plant and the Muara Tawar Gas Steam Power Plant in Bekasi.

A range of sanctions for PT TRPN

KKP then imposed administrative sanctions on PT TRPN for violating marine space utilization regulations, as stated in Minister of Maritime Affairs and Fisheries Regulation No. 31 of 2021.

Apart from the demolition sanction, other sanctions include written warnings, fines, temporary cessation of activities, temporary suspension of public services, site closures, revocation of approval documents, cancellation of approval documents, and the obligation to restore marine space functions.

PT TRPN instructed to independently demolish the sea fence in Bekasi waters

Special Staff to the Minister of Maritime Affairs and Fisheries Doni Ismanto believes that the demolition of PT TRPN's sea fence project in Bekasi should be carried out independently by the company, especially if the company's activities in Bekasi waters violate marine space utilization regulations.

"The enforcement process is ongoing, and it is clear who is responsible. Why should the state bear all the burdens if there is demolition?" Doni said when contacted on Saturday, February 1, 2025.

PT TRPN fined Rp18.6 million per hectare

According to Doni Ismanto, as a consequence of their actions, PT TRPN was fined an amount adjusted based on the area affected by the illegal activities. "It's Rp18,680,000 per hectare," he said in Jakarta on Friday, January 7, 2025, as quoted from Antara.

Dismantling of sea fence in Bekasi waters has commenced

The demolition of the 3.3-kilometer sea fence in the waters of Paljaya Village, Segara Jaya Village, Tarumajaya District, Bekasi Regency, began on Tuesday, February 11, 2025.

The demolition is being carried out independently by PT TRPN and is targeted to be completed within 10 days.

PT TRPN admits to permit violation

Deolipa Yumara also stated that the demolition of the 3.3-kilometer sea fence is being carried out with the awareness that their company had violated the zoning and reclamation permits in the area.

Deolipa explained that PT TRPN is a company engaged in fisheries ports. Up to now, PT TRPN does not have a Land Ownership Certificate (SHM) or Building Use Right (SHGB) in the Bekasi sea fence area.

"So if asked about the HGB, the answer is we don't have it. If the HGB is owned by the community. In fact, we are trying to manage what the community owns so that later we have the authority to manage it," she said.

Demolition overseen by KKP

The demolition of the sea fence is overseen by KKP. Director General of PSDKP Pung Nugroho Saksono said that they would oversee the demolition until it is completed.

"We oversee it every day," said Pung at the location. "It all has to be demolished. There's also a fine," he added.

PT TRPN claims losses of up to Rp200 billion

PT TRPN claims to have incurred losses of up to Rp 200 billion due to the demolition of the sea fence in Bekasi Regency waters.

"The losses are significant, up to Rp200 billion, from obtaining the old permits, making the port better; it's been a long process," said Deolipa Yumara, on Tuesday, February 11, 2025.

However, Deolipa stated that PT TRPN does not contest this issue because every endeavor will inevitably encounter gains and losses along the way. "Of course, there are always efforts and rights and wrongs in investment," she said.

PT TRPN will strive to comply with permits after the demolition

After the demolition of the sea fence is completed, PT TRPN will once again strive to comply with all permits for the utilization of marine space in the Tarumajaya waters of Bekasi.

"We will start again to comply with the prevailing regulations, both at the central and provincial levels. We will make every effort to obtain all necessary permits," said Deolipa.
