TEMPO.CO, Jakarta - The Indonesian government states that illegal mining activities violate Law No. 3 of 2020 and will be subject to criminal sanctions.
The Directorate General of Minerals and Coal at the Ministry of Energy and Mineral Resources, Tri Winarno, said that sanctions will be imposed on companies operating without permits during exploration and production operations, as well as individuals who store, use, or conduct processing and purification.
"They will face the same sanctions, which are imprisonment for up to 5 years and a maximum fine of Rp100 billion," Tri said during a working meeting with Commission XII at the Parliament Complex in Jakarta on Tuesday, November 12, 2024.
Based on police reports and expert testimonies, Indonesia recorded 128 cases of unauthorized mining in 2023, Tri said. These cases were spread across 24 provinces in the country, with the highest number in South Sumatra with 25 cases.
To address this issue, the government will take three steps. First, it will restrict the movement of illegal mining through digitization.
The Ministry of Energy and Mineral Resources has launched the Mineral and Coal Information System, dubbed SIMBARA. According to Tri, this system will integrate the monitoring and supervision of the coal trade process from upstream to downstream.
"If a company is operating without a permit and has no stock, it cannot make sales," he said.
The second step is to formalize areas with many illegal mining activities. If the mining activities meet the requirements and benefit the surrounding community, permits will be issued through People's Mining Permit (IPR) or Mining Services Business License (IUJP).
Third, the Ministry of Energy and Mineral Resources will establish the Directorate General of Law Enforcement (Gakkum) specifically to deal with illegal mining issues. It is regulated by Presidential Regulation (Perpres) No. 169 of 2024 on the Ministry of Energy and Mineral Resources, which was signed by President Prabowo Subianto on November 5, 2024.
"Finally, we will establish Gakkum, according to the presidential regulation, there will be a Gakkum Directorate General at the Ministry of Energy and Mineral Resources in the near future," Tri said.
