Indonesia Studies Transfer Options of Bali Nine Drug Convicts to Their Home Country Australia

TEMPO.CO, Jakarta - Indonesian Minister of Law Supratman Andi Agtas stated that his side is still studying the transfer options of five life sentence convicts of the Bali Nine drug network to their home country, Australia. Supratman said that his side is still studying the matter by involving other policy makers.

"Currently, we are still studying together with Minister Coordinating Human Development and Culture of Indonesia Yusril Ihza Mahendra (-Minister Coordinator of Legal Affairs, Human Rights, Immigration, and Prison Yusril Ihza Mahendra) and related stakeholders. The results of the study will later be consulted with the President of the Republic of Indonesia Mr. Prabowo Subianto, so that the decision to be taken is the best one," said Supratman through a written statement received by Tempo on Sunday, November 24, 2024.

In principle, said Supratman, the President of the Republic of Indonesia Prabowo Subianto has approved the transfer of foreign inmates to their home country.

"The President has approved in principle (the transfer of foreign inmates to their home country) based on humanity, and maintaining good relations with friendly countries," said Supratman.

Furthermore, Supratman explained that Indonesia does not yet have a permanent procedure for prisoner transfers, but his side will strive to expedite the process.

"This is important to maintain good relations with friendly countries. However, we must also ensure that partner countries respect the legal process in Indonesia," said Supratman.

According to Supratman, one of the requirements for the transfer of prisoners is that their home country must acknowledge the court decision in Indonesia. The reason is, Indonesia has the authority to prosecute foreigners who commit crimes within the territory of the Unitary State of the Republic of Indonesia (NKRI).

"The transfer of foreign inmates to their home country does not mean they are free, but they must serve their sentence in their respective countries according to the legal decision in Indonesia," said Supratman.

In addition to transferring prisoners to their home countries, Supratman continued, Indonesia will also endeavor to repatriate Indonesian prisoners currently held abroad.

"We also ask our families, Indonesian Citizens (WNI) who are abroad (as prisoners), to be able to return to Indonesia as much as possible in case of exchange. However, the mechanism is still under study," said Supratman.

Until now, said Supratman, his side has received letters from ambassadors of friendly countries regarding the transfer of foreign inmates to their home country.

"The ambassadors have sent letters to us and will be presented to the President regarding the request for extradition," he said.

The Bali Nine group was captured in 2005 while attempting to smuggle 8.2 kilograms of heroin out of Indonesia. They consisted of nine Australian citizens. They received various sentences, ranging from the death penalty, life imprisonment, to 20 years in prison.

Two masterminds of this group, Andrew Chan and Myuran Sukumaran, were executed in 2015. Meanwhile, Renae Lawrence was repatriated to Australia in 2018 after serving a 13-year prison sentence.
