TEMPO.CO, Jakarta - The Commission for the Disappeared and Victims of Violence (KontraS) urged the Indonesian government to support the United Nations resolution on a moratorium or temporary cessation of the death penalty.
KontraS coordinator Dimas Bagus Arya said support for the UN resolution will demonstrate Indonesia's commitment to protecting Indonesian citizens who are facing the death penalty abroad.
Based on the report from the Ministry of Foreign Affairs, hundreds of Indonesian nationals are facing the death sentence. "As of June 2024, 165 Indonesian nationals face the death penalty abroad, with the majority in Malaysia (155 people), while the rest are in Saudi Arabia (3 people), Laos (3 people), and Vietnam (1 person)," said Dimas in an official statement quoted on Tuesday, November 12, 2024.
Consequently, Dimas said, implementation of the moratorium on the death penalty is an initial step towards the death sentence abolition. In the 2024 annual report on the death penalty, KontraS noted that courts and prosecutors still frequently demand and impose the death penalty.
"(This) reflects concerning legal policies, even though the new Criminal Code has been enacted and will come into effect in 2026, where the death penalty will only be a last resort or an alternative," said Dimas.
According to him, the troublesome conditions of prisons in Indonesia, the lack of oversight, and limited access to healthcare for inmates emphasize the urgency of implementing the moratorium on the death penalty.
KontraS also urges the government through the Ministry of Foreign Affairs to declare support at the UN General Assembly on the 10th Resolution for a Moratorium on the Death Penalty, which will be held in December 2024.
According to Dimas, this support reflects Indonesia's legal policy adjustments towards the renewal of criminal law in line with the spirit of the new Criminal Code, which will take effect in 2026.
Furthermore, KontraS requests the Ministry of Foreign Affairs to coordinate with other ministries to improve human rights situations, especially on death penalty verdicts in Indonesia. "To prevent contradictions between international rhetoric and national policies," said Dimas.
Previously, KontraS noted that there were at least 32 death sentences imposed between October 2023 and September 2024. As many as 20 were imposed on drug-related convicts, while the remaining 12 concerned murder charges.
KontraS also accounted for 35 death penalty petitions filed by prosecutors across the country, with district prosecutors filing the most requests with 32 petitions involving 61 defendants.
