TEMPO.CO, Jakarta - Minister of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) Nusron Wahid said that his party will immediately revoke the building use rights certificate (SHGB) and ownership rights certificate (SHM) for the sea fence in the waters of Tanjung Pasir, Teluk Naga, Tangerang, Banten.
According to him, the issuance of hundreds of SHGB and SHM in the coastal area of Tangerang waters was procedurally and materially flawed.
"Because of the procedural and material flaws, based on PP Number 18 of 2021, as long as the certificate is not yet 5 years old, the Ministry of ATR/BPN has the authority to revoke it or cancel it without a process and order from the court," said Nusron Wahid to reporters after reviewing the location of the sea fence in the waters of Tanjung Pasir, Teluk Naga, Tangerang, Banten, on Wednesday, January 22, 2025.
Nusron explained that from the results of the review and examination carried out by his team, some of the SHGB and SHM that were reported were outside the coastline. That area, he said, is not allowed to be owned by individuals so it cannot be certified.
Nusron said that hundreds of certificates were issued on average in 2022-2023, which means that they were issued in less than five years. Therefore, SHGB and SHM sea fences in the Tangerang waters can be automatically revoked or null and void by law. "That is a sufficient requirement to review and cancel the certificate," he said.
Previously, Nusron confirmed that the 30.16-kilometer sea fence in Tangerang already had HGB and SHM status.
"We confirm that there are certificates circulating in the sea fence area, as has appeared on many social media," said Nusron Wahid as reported by Antara on Monday, January 20, 2025.
A total of 263 plots of land are recorded in the form of HGB, with details of 234 plots owned by PT Intan Agung Makmur, 20 plots by PT Cahaya Inti Sentosa, and 9 plots in the name of individuals.
In addition, there are 17 plots of land in the area that have Freehold Certificates (SHM). Nusron added that if the results of the coordination show that the certificates are outside the coastline, an evaluation and review will be carried out.
