TEMPO.CO, Jakarta - Technology billionaire Elon Musk expands his lawsuit against OpenAI. He adds federal antitrust claims and other claims and adds the biggest financial backer of OpenAI, Microsoft as a defendant, as reported by Reuters.
Musk's lawsuit filed on Thursday, November 14, 2024, in a federal court in Oakland, California, states that Microsoft and OpenAI illegally attempted to monopolize the generative artificial intelligence market and eliminate competitors.
The expanded lawsuit states that OpenAI and Microsoft violated antitrust laws by requiring investment opportunities in agreements to not deal with rival companies. It is mentioned that the company's exclusive licensing agreement is a merger without regulatory approval.
Similar to Musk's initial complaint in August, he accuses OpenAI and its chief executive, Samuel Altman, of contract violations by prioritizing profits over public interest in advancing AI. The lawsuit aims to revoke OpenAI's license with Microsoft and force them to withdraw profits obtained "unfairly".
"No company has ever transformed from a tax-exempt charity to a giant profit-making company of 157 billion US Dollars and crippled the market in just eight years," reads the lawsuit.
OpenAI in a statement said the latest lawsuit is "even more baseless and overreaching" than the previous lawsuit. Microsoft declined to comment.
"Microsoft's anti-competitive practices have escalated," said Musk's lawyer, Marc Toberoff, in a statement. "Sunlight is the best disinfectant."
Musk has long been at odds with OpenAI. Musk himself is one of the founders of OpenAI back in 2015. He has often criticized the company and its leaders in the following years. Musk resigned from OpenAI's board of directors in 2018.
Musk has gained new attention as a key player in the incoming US President Donald Trump's government. Trump appointed Musk to a new role designed to reduce government waste, after he donated millions of dollars to Trump's campaign.
