Indonesia to Draft Regulation on Assigning Police to Civil Service Roles

TEMPO.CO, Jakarta - Indonesia's Government regulation on the placement of active police officers in civilian roles will soon be formulated. The assignment of police officers to 17 ministries/agencies was previously regulated in National Police Regulation Number 10 of 2025, which was deemed to conflict with the Constitutional Court's decision.

Coordinating Minister for Legal, Human Rights, Immigration, and Correctional Affairs, Yusril Ihza Mahendra, stated that this step was taken because the assignment was not sufficiently regulated internally. "Therefore, the future regulation will be established at the Government regulation level," said Yusril.

Yusril stated that the government aims to end the debate on the legal status of regulations regarding the placement of active police officers in civilian roles. "Hopefully, in the near future, we can complete the draft of the Government regulation," Yusril said in his written statement.

According to Yusril, the 17 related ministries/agencies will be involved in the drafting of the regulation. Yusril claimed that the majority of these institutions still need personnel assistance from police officers.

Chief of Police General Listyo Sigit Prabowo previously stated that the regulation on the placement of active police officers in civilian roles will be elevated to a Government regulation. "So, what was mandated by the Constitutional Court's decision can be followed up more clearly and firmly," he said at Halim Perdanakusuma Airbase on Friday, December 19, 2025.

Academics from the Faculty of Law at Gadjah Mada University, Herlambang P. Wiratraman, stated that the subject matter of placing active police officers in civil institutions cannot be regulated at the Government regulation level. This is because the new regulations govern authorities that were not previously regulated.

Herlambang explained that the formulation of a Government regulation is usually a direct mandate from the predecessor Law or delegated legislation. Government regulations can also contain the implementing rules of a Law. "(The National Police Regulation) is neither of these," said Herlambang on Sunday, December 21, 2025.

Therefore, Herlambang suggested that the Chief of Police immediately annul the regulation. The regulation should be revoked while awaiting discussion at the legal level. "Without the need for pressure or even material review lawsuits," said Herlambang.

Herlambang stated that the placement of active police officers in civil institutions should be regulated through a revision of the National Police Law. However, he cautioned that the discussion of the regulation should be open.
