TEMPO.CO, Jakarta - Former investigator of the Corruption Eradication Commission (KPK), Novel Baswedan, highlighted the ongoing public discourse surrounding the alleged gratification case involving Kaesang Pangarep and his use of a private jet.
Novel urged the KPK to swiftly clarify the distinction between gratification in the context of prevention and gratification classified as a criminal offense. This is to avoid prolonged controversy that could damage law enforcement's image in the public eye.
“It seems that the KPK needs to learn to differentiate between gratification in the prevention context and gratification in the criminal context,” he said following a discussion forum in South Jakarta on Wednesday, November 6, 2024.
Novel, who is the Deputy Head of the Special Corruption Prevention Task Force of the Indonesian National Police, mentioned that KPK needs to be more transparent in explaining the assessment process for gratification cases so that the public can understand the reporting requirements for prevention-related matters and identify instances that may constitute criminal offenses.
He noted that gratification is not only about gifts related to official positions but also involves the intent and context of acceptance. In the case of Kaesang’s private jet usage, Novel implied that KPK needs to conduct a thorough investigation to clearly delineate between reportable gratification and criminal offenses.
To ensure clarity and consistency, Novel proposed that the KPK consult with legal experts to refine guidelines on gratification within the framework of Indonesian law. This would enable the KPK to make unbiased decisions and set a strong precedent for the public regarding the legal implications of various forms of acceptance.
“I believe the KPK needs to learn, invite legal experts, and seek their insights to provide clearer explanations,” he added, stressing that by doing so, the KPK could differentiate between forms of gratification that necessitate reporting for preventive measures and those that warrant a criminal investigation.
