TEMPO.CO, Jakarta - A single judge at the South Jakarta District Court, Tumpanuli Marbun, rejected the pretrial motion filed by former Trade Minister Tom Lembong. With this decision, Thomas Trikasih Lembong remains a suspect in the sugar import corruption case.
"Rejecting the applicant's pretrial motion as a whole," read Tumpanuli on Tuesday, November 26, 2024.
The dissatisfied court audience boo-ed after the verdict was read, causing the atmosphere to become rowdy a moment after the judge banged his gavel.
Observations by Tempo at the location showed that the session scheduled for 2:00 p.m. started a little late at 02:10 p.m. Nevertheless, visitors had already filled the courtroom half an hour earlier.
Among the trial audience was Tom Lembong's wife, Ciska Wihardja. His supporters were also seen donning floral-patterned headscarves.
Tom Lembong officially filed a pretrial motion at South Jakarta District Court on November 5, 2024, as registered by his lawyer Ari Yusuf Amir.
Ari said his team challenged the validity of Tom Lembong’s suspect designation and the detention order issued by the Attorney General’s Office on Tuesday, October 29.
"This request is aimed to demand the validity of our client's suspect designation and detention," said Ari at South Jakarta District Court on Tuesday afternoon.
According to Ari, the legal team representing Tom Lembong requested the court to declare the former minister’s suspect designation and detention as invalid. The team also asked the South Jakarta District Court to order the Attorney General’s Office to release Tom Lembong from detention.
Ari claimed there were several irregularities in the legal process of designating Tom Lembong as a suspect and detaining him. These include the lack of the right to appoint his own legal counsel, insufficient preliminary evidence, an arbitrary investigation process, baseless detention, and a lack of evidence of criminal acts.
