TEMPO.CO, Jakarta - Three defendants in the alleged tin corruption case in Bangka Belitung face up to eight years in prison. Two of the accused are Achmad Albani and Hasan Tjhie, both top executives of private tin smelter company CV Venus Inti Perkasa, and the third is tin ore collector Kwan Yung a.k.a. Buyung.
Kwan Yung, Hasan Tjhie and Achmad Albani were charged with being involved in hosting illegal tin mining activities in the area of PT Timah Tbk's mining business license (IUP) between 2015 and 2022. They were charged together with tin businessman Tamron Tamsil a.k.a. Aon.
The prosecutor requested the Corruption Court judges to declare that Kwan Yung, Hasan Tjhie and Achmad Albani had been legally and convincingly proven guilty of corruption and money laundering (TPPU).
"The 8-year prison sentence can be reduced by the time the defendants spend in custody, with an order that the defendants remain in custody," the public prosecutor (JPU) said at the Central Jakarta Corruption Court on Monday, December 9.
The JPU also demanded that the three defendants pay a fine of Rp750 million, which can be replaced by an additional 6 months in prison. However, the JPU did not demand any restitution from the three defendants.
In the indictment, the prosecutor deemed the three defendants guilty of violating Article 2 (1) in conjunction with Article 18 of the Corruption Law (UU Tipikor) and Article 3 of the Money Laundering Law (TPPU) in conjunction with Article 55 (1) ke-1 of the Criminal Code.
Achmad Albani is the general manager of operations at CV Venus Inti Perkasa and PT Menara Cipta Mulia. Meanwhile, Hasan Tjhie is the President Director of CV Venus Inti Perkasa. Kwan Yung a.k.a. Buyung is a tin ore collector. Meanwhile, Tamron a.k.a. Aon is the beneficial owner of CV Venus Inti Perkasa, a private tin smelting company.
In the same case, Tamron faces a sentence of 14 years in prison. The prosecutor also demanded that Tamron pay Rp3.66 trillion in restitution.
In this tin corruption case, Tamron and others were also charged with incurring financial losses to the state of over Rp300 trillion, based on an audit conducted by the Finance and Development Supervisory Agency (BPKP) on May 28, 2024.
