TEMPO.CO, Jakarta - The Minister of Home Affairs, Tito Karnavian, has agreed to the House of Representatives' (DPR) proposal to revise Law Number 2 of 2024 concerning the Special Region of Jakarta (DKJ Law). This agreement was reached during a working meeting on Monday, November 18, 2024.
“The government recognizes the necessity of the proposed article insertions by the DPR to ensure legal certainty regarding Jakarta's future governance transition,” Tito said on Monday, November 18, 2024.
He highlighted the need to amend the DKJ Law to prepare for the eventuality of Jakarta no longer being the capital. Article 70 of the current law stipulates that Jakarta's capital status will be revoked upon the issuance of a Presidential Decree regarding the capital's relocation to Nusantara or IKN in North Penajam Paser, East Kalimantan.
“Adjustments to the articles are crucial to enable the Special Region of Jakarta to effectively prepare for economic, social, cultural, political, and other potential changes arising from the capital's relocation,” Tito explained.
Although Jakarta remains the capital, Tito emphasized the need to change the province's nomenclature from DKI Jakarta. He argued that the existence of the DKJ Law renders the Law on the DKI Jakarta Province obsolete.
“This change is intended to provide legal certainty and a new nomenclature for Jakarta's governance,” Tito stated during the meeting.
Meanwhile, Bob Hasan, Chair of the DPR Legislation Body, confirmed that a working meeting with the government will be held to discuss the DKJ Law revision. He noted that the Legislation Body is awaiting the government's Inventory of Issues (DIM).
“We will finalize this and hold a meeting with the DPR before bringing it to the working committee,” Bob said.
He classified the DKJ Law revision as an open cumulative Draft Law, which does not require prior approval as a Draft Law in the National Legislation Program by the DPR.
