Prosecutors Cite State Loss of Rp 300 Trillion as Aggravating Factor in Demands Against Harvey Moeis

TEMPO.CO, JakartaThe public prosecutor explained that the aggravating factor in the Harvey Moeis case is the defendant's failure to support the government in maintaining clean and corruption-free governance, which caused a state loss of up to Rp 300 trillion.

The prosecutor also assessed that Harvey's actions have profited him Rp 420 billion. He also provided convoluted statements during the trial.

"The mitigating factor is that the defendant has never been convicted before," stated the Prosecutor.

The public prosecutor previously charged Harvey Moeis with corruption in the tin trading sector in the IUP PT Timah area from 2015 to 2022 and money laundering.

Harvey Moeis was then sentenced to 12 years of imprisonment for alleged corruption in tin trading management in the IUP PT Timah mining license area from 2015 to 2022.

"Imposing a prison sentence on Harvey Moeis for 12 years," said the prosecutor during the Corruption Court in Jakarta trial on Monday, December 9, 2024.

In addition to imprisonment, Harvey Moeis is also fined Rp 1 billion. If the fine is not paid, it will be substituted with a one-year confinement.

"The defendant is ordered to pay restitution of Rp 210 billion," the prosecutor stated. If Harvey cannot pay the additional penalty, his assets will be confiscated. If insufficient, he will be sentenced to another 6 years in prison.

The prosecutors also demanded that the judges impose an additional sentence on Harvey Moeis in the form of payment of damages amounting to Rp 210 billion, substitutable with six years of imprisonment.

Prosecutors explained that the aggravating factor in the demand against Harvey Moeis is the defendant's failure to support the government in maintaining a clean and corruption-free governance, causing a state loss of up to Rp 300 T or Rp 300 trillion.

According to an audit by the Financial and Development Supervisory Agency (BPKP), this case is suspected of causing state losses amounting to Rp 300 trillion. Meanwhile, environmental experts from the Bogor Agricultural University or IPB University estimated state losses due to the tin case to reach Rp 271 trillion.

Harvey Moeis is charged with violating Article 2 paragraph (1) or Article 3 in conjunction with Article 18 of the Corruption Eradication Act amended by Law No. 20 of 2001, Article 55 paragraph (1) 1st point of the Indonesian Criminal Code, and Article 3 or Article 4 of Law No. 8 of 2010 on the Prevention and Eradication of Money Laundering.
