Manpower Ministry Admits Online Ojek Partnership Status Disadvantageous for Workers

TEMPO.CO, Jakarta - The Indonesian Ministry of Manpower will review the partnership status between online ride-hailing operators and their partner drivers such as online motorcycle taxis or online ojek, online taxis, and couriers. Online transportation drivers asked the government to regulate the partnership status between workers and platforms it is disadvantageous for the former.

"In my opinion, it is very disadvantageous for the online ojek," said Deputy Minister of Manpower Immanuel Ebenezer or Noel when contacted on Thursday, 24 October 2024.

Noel mentioned that this issue was a special concern for his ministry. He said the Ministry of Manpower would review the definition of 'partnership' that was considered misleading. "The term 'partnership' is a misconception that disadvantages online motorcycles. We will respond shortly, and surely before 100 days," said Noel.

President Prabowo Subianto has inaugurated the Professor of Bandung Institute of Technology (ITB) Yassierli as the Minister of Manpower and Noel as the Deputy Minister in the Red and White Cabinet. Yassierli is currently designing the first 100 days of the work plan. According to him, the ministry will discuss provincial minimum wages, upskilling, and reskilling of workers. However, Yassierli did not discuss the issue of online motorcycles in his 100-day work program.

SPAI Asks to Abolish Partnerships: Mentioning Job Risks and Low Wages

The Indonesian Transportation Workers Union (SPAI) asked Yassierli to set the status of online transportation drivers, such as online ojek, online taxis, and couriers, as permanent workers. SPAI considers this step so that online ride-hailing drivers can obtain workers' rights including the minimum wage according to the Manpower Law.

"Therefore, we urge the new Minister to immediately realize the Manpower Ministerial Regulation that protects platform workers," said SPAI Chairperson Lily Pujiati in her written statement on Thursday, 24 October 2024.

In determining the minimum wage, Lily said the Minister should look at the alarming income conditions for online ojek, online taxis, and courier drivers, as their partnership status makes the income of these workers unpredictable. "Every month, the income of online ojek drivers is below the minimum wage standard," she said.

Lily said this partnership relationship causes the platform to set low rates unilaterally. She mentioned the companies also cut workers' earnings that exceeded the 20 percent limit. The platform cuts earnings between 30-70 percent through additional service fees and other charges borne by consumers.

As a result, the average monthly income for these online transportation workers is only Rp3 million. "We have to work from morning till night, about 15-17 hours every day. And we have to work without a day off for a month," said Lily.

However, Lily said the Rp3 million income does not apply to female workers. Without paid leave for menstruation, childbirth, and the possibility of miscarriage, Lily said female workers' income could be even lower. "Not to mention the risks on the road, where we are prone to accidents due to fatigue and lack of rest. If we have an accident, it is considered a road accident, not a work accident," she said.

However, Lily said that if these online transportation workers are recognized under the law, they will receive employment benefits from the Manpower Social Security (BPJS Ketenagakerjaan), social security guarantees, and accountability from the platform. "With partner status, we automatically do not receive the social security, which should be the responsibility of the platform there," Lily said.
