Five Bali Nine Members Repatriated to Australia Remain Prisoners: Indonesian Minister

TEMPO.CO, Jakarta - Coordinating Minister for Law, Human Rights, Immigration, and Corrections (Menko Kumham Imipas) Yusril Ihza Mahendra stated that five foreign nationals (WNA) convicted in the Bali Nine case returned to Australia remain prisoners. The Indonesian Government returned the five convicts of drug smuggling to their home country on Sunday, December 15, 2024.

Yusril mentioned that the Indonesian Government does not grant clemency to the Bali Nine members despite agreeing to return them. According to Yusril, the status of being a prisoner is part of the 'Practical Arrangement' signed by the Indonesian and Australian Governments on December 12, 2024.

"Their status remains as prisoners. We transfer them to Australia as prisoners. The Indonesian Government does not grant any form of clemency," said Yusril in a written statement on Sunday, December 15, 2024.

In the agreement, Yusril said, the Australian Government respects Indonesia's sovereignty and court decisions. The Bali Nine convicts are also on the exit ban list (cekal) and cannot re-enter Indonesian territory. Australia will also provide Indonesia with information regarding the status and treatment of Bali Nine members after the transfer.

Yusril stated that the prisoner transfer agreement was signed based on the principle of reciprocity. "Indonesia and Australia are committed to continuously cooperate on issues pertaining to mutual interests according to the domestic legal framework," said Yusril.

The five Bali Nine convicts are Scott Anthony Rush, Mathew James Norman, Si Yi Chen, Michael William Czugaj, and Martin Eric Stephens. The handover to the Australian Government took place at VIP II Swarawati Building, I Gusti Ngurah Rai Airport, Bali.

The handover was conducted by several officials from the Directorate General of Corrections RI to the head of the Class IIA Kerobokan Bali Correctional Institution (lapas). Meanwhile, the Australian government was represented by Minister-Counsellor Home Affairs Lauren Richardson and several representatives from the Australian Embassy in Jakarta.

Bali Nine is the nickname for nine Australian convicts arrested in Bali involved in a drug syndicate case in 2005. They were found guilty of smuggling 8.2 kilograms of heroin.

The nine convicts are Andrew Chan, Myuran Sukumaran, Si Yi Chen, Michael Czugaj, Renae Lawrence, Tan Duc Thanh Nguyen, Matthew Norman, Scott Rush, and Martin Stephens. Currently, five Bali Nine convicts remain in Indonesia: Si Yi, Michael, Matthew, Scott, and Martin.

Andrew and Myuran were executed in 2015, Renae was released in 2018, while Tan Duc died in 2018 while serving a life sentence.
